A multimillion-dollar construction dispute is unfolding over water damage at an East Austin apartment complex, after property owner Greystar Real Estate and affiliated insurers filed suit against the project’s general contractor and several subcontractors. The plaintiffs allege that installation and oversight failures in a hot-water system triggered a chain of events that damaged the property and resulted in more than $10 million in repairs.

The lawsuit centers on Urban East Apartments, a 381-unit complex near the Montopolis and East Riverside areas. Court filings described work led by San Antonio-based Bartlett Cocke General Contractors, with additional responsibilities assigned to multiple subcontractors and professionals named as defendants.

What the plaintiffs say happened

The suit alleges that plumbers improperly installed the hot-water system in one of the complex’s buildings by failing to include a thermostatic mixing valve—a component intended to limit water temperatures delivered through the system. The complaint describes a critical moment in December 2023, when the complex’s boilers were turned on and water temperatures reached the system’s stated maximum of 180 degrees.

According to the allegations, the high temperatures contributed to a PVC pipe separating on the building’s fourth floor. The plaintiffs contend that once the pipe separated, water leakage began and damage expanded across the property.

The complaint attributes varying roles and alleged failures to the defendants, including insufficient oversight, improper installation, and failure to review or reduce system temperatures.

The lawsuit frames the incident as preventable and tied to installation and quality-control decisions made during construction and commissioning of the building systems.

Insurers Allianz Underwriters, Steadfast Insurance Co., and Starr Surplus Lines Insurance Co. are also plaintiffs in related claims seeking to recover insurance payouts associated with the repair work described in the filings.

Where the case is headed

The suit was filed after repairs were completed and after insurance payments were made, shifting the dispute to who ultimately bears financial responsibility. The case has moved to the Texas Business Court, Third Division in Austin, placing the conflict within a specialized venue designed for complex commercial matters.

The allegations remain unproven unless established in court. The outcome is expected to turn on technical questions about construction standards, system design choices, commissioning practices and contractor oversight across multiple parties.
